    Throw out Jack's "evidence"!

Please, please, Y&R, have Christine throw out that Phyllis "evidence" Jack and Kyle found in the motel. No self-respecting DA would accept it. Jack could have broken into wherever Phyllis lives now and found hair strands on her pillow!

Tweedle-dum Jack and Tweedle-dee Kyle are laughable.

I expect it will be thrown out. They went ROGUE. Therefore, it is totally inadmissible. Apparently, no one in Genoa City ever watches "Law & Order," and all its offshoots, or even true crime documentaries. It is obvious the WRITERS don't watch them, either.

henyvo02 That motel room had more than likely been turned over (hospitality industry lingo for cleaned/disinfected) and would’ve been compromised for any forensic evidence, anyway. Except, it could still be ‘luminol’d’ for the presence of blood/carpet fibers. ‘Course, probably the presence of DNA for either Stark/Phyllis would be compromised, also 🤷🏾‍♀️

But I give Jack/Kyle an A+ for effort in doing all they can to prove their loved one’s innocence. All families care more about their loved ones than any authority does! In Soapland, justice is NOT blind!

Soapfan54 If Jack and Kyle would have called Chance and taken him with them to the motel and had Chance do a proper search then the hair would have been valid evidence to set Diane free or at least start looking for Phyllis , Jack actually thought by him finding the hair it was going to set Diane free that thought alone makes Jack look stupid and what good would luminol do even if they found something there is no proof when it got there it is an old cheap motel it could be anyone's from anytime . We know Jack thought this evidence would set Diane free by his words and by the fact when they went to the room they used gloves and plastic bags so as not to contaminate anything

henyvo02 Chance wouldn’t’ve done didilysquat, as he proved by his defensive posture in today’s scene. He’s waiting on Summer to “confess.” That way, he won’t actually need to lift another finger to reopen an investigation into this bogus case against an accused No matter how much one despises Diane, she is INNOCENT of the charge against her!

Meanwhile, I’m enjoying Jack/Kyle staunchly defending/protecting their familial loved one, and their frantically working to prove her innocence. Their actions are the definition of love and courage—and the complete opposite of “stupid.”

Agreed. Jack is being really foolish if he thinks for one second that would be admissible as evidence that Phyllis is still alive.

It was never evidence. Not with so many people who have stayed there, cleaning, etc.. It was just to support Daniel’s story. And to show Chance how he was missing so much because he’s not a competent detective and lazy.

they have no choice but to toss it. can't be verified. cops are not doing a good job on this case and if they ever accepted Jack findings they would be doing a worse job.

Why are they not doing a good job? The evidence they have compiled against Diane has been very strong and they have not been able to find anything that would dispute it except Jack and Kyle saying Diane is innocent. I think audiences are sometimes influenced because they know what is occurring but forget that the characters do not. Why would the police just take Jack's word for it? Of course they are going to go with the evidence they have in their hands that are not just theories. Jack and Kyle have been dumbbells from the start with this with their demands and disrespectful behavior towards the police. Had Michael informed Chance of their latest findings and the fact that Phyllis might be alive, he would have followed up on it.

What a private citizen finds during an illegal search just might be admissible since the supposed victim not being dead is extremely relevant. Jack and Kyle were not acting on behalf of the police, but for themselves. So they might just be able to blow up Phyllis' scheme with a DNA match.

Cricket should lose her new job after the charges against Diane are dropped and Summer might end up being charged with obstruction.

How? They make their statements. Then they testify in court.

It's up to the jury. But there is so much shadiness here that finding DNA in a sleazy rest that is a match to Summer lends credibility to Daniel's story that his mom faked her death,, along with all the other bull rap I've been posting on. There's more than reasonable doubt here.

And. The burden of proof is always on the prosecution. Cricket and Chance seem to be forgetting that.

bluejazz It is up to a judge if the evidence can be presented in court and no self respecting judge would allow it so the jury would never see it or hear about it . Sure Jack can testify but any good DA would rip him apart and ask him about setting Stark up for theft Jack's credibility would be ruined and no one would believe him

bluejazz Chance has not forgotten that - they believe they have the proof and they could also cast doubt that Jack and Kyle found that hair in the motel. The D.A. could make a case that the hair was taken from a brush of Phyllis which is also reasonable doubt. Jack and Kyle's case is full of holes because they took it upon themselves to go rogue.

Chance pretty much just did that. He told Jack and Diane that they were both not above faking evidence. The hairs could have been in the room
any time. Jack's face looked sheepish but he said nothing.

Chance was defensive in that scene, bringing up Jack/Diane’s legally unpursued stolen necklace caper to set Stark up as a deflection to excuse his infuriating obtuseness. Meanwhile, he’s meeting Summer for a beverage, sympathy, and hoping she’ll do his job for him by “confessing” that she saw her mother alive MUCH bias at play here! 🤨

Soapfan54 Chance was proving the lengths Jack would go to to protect Diane by bringing up the theft it was not a deflection at all it was proof that Jack is not beyond faking evidence so why should he believe him now when Jack has done this before

henyvo02 No, he wasn't proving anything, he was deflecting. He let the Newman's slide covering up Ashland's death; and never pursued Jack/Diane IF he believed they had broken the law. Funny how he's now covering for Summer, but has the nerve to lecture Jack? But it's all good, 'cause Phyllis is alive. Soon, Diane will be exonerated and Chance/Christine will look like the incompetent fools they are.

I'd LOVE for tptb to show Diane pursuing a lawsuit against the incompetent GCPD and the malpracticing D.A.'s office, like Victor did when Christine wrongfully prosecuted The Coven for JT's 'supposed' murder. Diane should also file a complaint against Christine w/the Bar Association, as she is a menace to society! The second time being sued/costing the State of Wisconsin $$$ should be the nail in the coffin of public service for her. And Chance needs to be fired!

It definitely gave him more to consider especially after getting weird vibes from Summer and Daniel. That’s the best I think Jack could hope for at this point. GCPD has been insistent that the evidence they have is strong and outright told Jack they weren’t going to devote department resources on researching any of Jack and Kyle’s theories.

Jack says Chance's Ego is what is standing in the way of him accepting the evidence. Jack, Chance's Ego! Diane can't believe them setting
up Jeremy Stark has come back to bite them.
Are these three in a parallel universe?

Oh I believe they believe it, just regret it. Clearly that stupid plan of Jack’s was all to now delay GCPD into following through looking for Phyllis and thereby releasing Diane once Phyllis’ existence is established somehow.

And in a way it is Chance’s ego not being more open to Phyllis being alive all this time. The fact that her own son would swear he saw her kind of says that to me. Not enough to drop charges on Diane but certainly should have raised enough doubt to put an investigator or two on looking for evidence like what Michael’s guy turned up.

TunerEyes They could have used what Micheal's guy turned up if they had told them but they did not tell Chance or the police but decided to do it on their own .I think Chance is very open to Phyllis being alive he may even think she is but he is a cop he needs solid evidence not theories and if Jack and Kyle would have called him about the motel and taken him with them they would have that evidence

Kyle and Jack are dumb. They should have called the police--who are supposed to be investigating Stark's death and would want to know the last place he stayed and let it play out. But no they had to go play hero and now the whole crime scene is contaminated. Since they admit being there who is to say they didn't plant evidence or tamper with anything else? It's all useless now.

LE will usually refuse to investigate when their suspect has been charged. Their job is done. Michael should have done his job and presented this to Cricket as is his legal responsibility.

And given that there are giant holes regarding EVERY SINGLE THING about this case, DNA evidence that the alleged victim is still alive is exculpatory evidence. Cricket is wasting the taxpayers money by pursuing a case that doesn't have a body or a definitive cod that supports murder charges. There is far more than reasonable doubt here. And she's laying the city open to a large civil suit by Diane.

I find Chance and Cricket deliberately obtuse and arrogant here, not to mention dead stupid.

Unfortunately Michael along with Jack and Kyle went along with Daniel wanting to essentially unbeknownst to them buy his mom and Summer more time to put some plan to into effect for Phyllis to once again skate from responsibility….wrongly believing Phyllis was coerced and had no willing part in this. Even Phyllis managed to snow Summer.

So hope oh holy Phyllis has her fall from “grace” and her arrogance at thinking she can do whatever and always escape responsibility comes to an end. Not to mention the real criminal charges she most certainly qualifies to be charged with and found guilty of.

Where are her clothes? That is where they could have found strands of hair on something since we naturally lose it every day. The police would have to run another dna test on hers and Summers hair for absolute proof it is Phyllis's. Proving where and when it came from would be more difficult but it couldn't be thrown out. The defense would fight for it as evidence and the prosecution against and it would be up to the jury to decide.

I don’t believe for a SECOND that Jack or Kyle thought the police would accept their matching hair evidence at face value since the department didn’t do the investigating or collection of it. May have said that to Chance but really don’t think they believed that. They admitted there were not ideal circumstances about how it was acquired. Sure posture to Chance, sounds good but not realistic given circumstances.

Most importantly the guys knew that Chance had shut the door on investigating their theory and subsequent statement by Daniel about Phyllis being alive and involved in an elaborate frame up, so what alternative did they have to get the case reopened. It wasn’t intended as proof positive but something worth looking further into. The guys really aren’t that stupid, just incredibly frustrated.

My question is how did they get the DNA test processed in less than 24 hours? Thought he said something about retrieving it “last night”. Or is it b/c he’s Jack Abbott, the lab put his request at the top of the list?

I absolutely LOVE it!! These two Abbott men are so clueless and brainless… the fact that they framed an innocent man not long ago and got AWAY with it and NOW go out and grab so called evidence thinking they are once again above the law and expect to be taken seriously?! I love that all their foolishness blew up in their face .. and instead of helping Diane’s case they just put more holes in!! Serves those two moron Abbott men right .. let Jacky boy & Kyle stew in their stupidity and I don’t blame Summer for taking off when they put on their fake CSI skit for Chance.. an actual cop .. how embarrassing as Jack and Kyle are merely a shell of a man of what they once were before Diane slithered back into town and took over their lives.

The question is WHY didn’t Chance know about the motel room? If he were doing his job he should be in contact with the police from the place where they found Stark’s body since there is a connection between Stark and Phyllis. I can’t blame Jack and Kyle since the police are not doing there job.

Because with all the set up / Evidence that Mr. And Mrs Stark planted . The poison in Diane's credit card name that Phyllis stole out of Diane's purse .the fight against Diane and Phyllis at the athletic club. The recording of Phyllis telling Michael she was afraid that Diane was going to kill her . The planted note in the Abbott house more than likely planted with the female cop that came down in 2 seconds with the note. Christine and chance really did think that they had a slam dunk case against Diane .

All that evidence is flimsy at best and once Stark was killed it was a whole different story especially since Diane was in jail. Is it any wonder Christine can’t win a case
