Xander should be in jail, and Victor should be charged as well. I don't get it? Everyone knows they had the babies switched, don't they?

No way does xander belong in jail he had nothing to do with the babyswitch.if there is any character that belong in prison it is for rafe who help hope cover up stefano murder.

What does Rafe have to do with the baby switch?? What he did for Hope in regards to Stefano has nothing to do with this! As for Xander not having anything to do with it, Um, yeah, he absolutely does! Xander is the one that actually switched the babies, on Victor's order. So, perhaps you forgot that vital piece of info.

The incompetency is a given....hard earned recognition of their non-talents. Of course, now it's even worse cuz Rafe has his head up his @ss most of the time because of the David custody problem at home. Imo, Rafe and Hope were the worst cops ever at the SPD. It was far more effective when Roman ran it.

Victor and him should be in jail. Even Evan, and his father as well. Pretty sure they will not be happy when Rafe gives them his famous smug look!He will say, "I got custody of David and we are going on a long vacation from Salem". That would be his famous departure from Salem.

You've probably watched as long as I have. Anyone named Brady or Horton don't go to jail. Not really. And Sami has killed people, run off and abandoned Will without so much as a goodbye (he was a little boy at the time) - tried to kill way more than she succeeded in doing, and still runs around free. Even Bo and Hope illegally detained someone they thought was guilty of something til they found evidence to convict him. You have to suspend reality with Days

Because Rafe is too busy trying to take someone else's kid to do his job, Lani is incompetent, and Eli is being dragged down for whatever reason. Just look at the Kiriakis mansion crime scene. Since when do you travel to question the person who found the victim before securing the crime scene?

Thinking about this more, there is actually no real proof that Xander switched the babies. Yes everyone knows it was done but there is no real proof who was responsible. Xander only admitted it to Sarah and Kristen even if they testified it’s only hearsay. They would need the doctor to come back and testify and she has every reason to avoid that.

Dr. Raynor and the lab tech came clean to Nicole I think. But I don't think either one of them has cooperated with the police. I doubt they're going to throw away their careers and their income to help expose Xander.
And the courts haven't ordered a DNA test yet. I don't think the dna test the lab tech (who faked one already) ran will be enough to compel the court to act in this case. And the courts can't run one now while the legal mother has fled the country.
Right now this child is legally Sara's. In many states a father with an illegitimate child does not get legal rights to the child unless he goes through a legal process called legitimation where he legally acknowledges the child as his child (his name being on the birth certificate, paying child support or raising him/her...not enough).
I think the best legal strategy would be for Eric to file a kidnapping claim but even then I think there's a 50% chance that won't work. I don't think Brady and Kristen have the standing to do so at this time until they prove they are Rachel's parents...which they can't unless Sara returns.
